Successor Agency to the Redevelopment Agency of the City of San Jose

Effective February 1, 2012, all redevelopment agencies in the State of California were dissolved pursuant to AB 1X 26. Although the Redevelopment Agency of the City of San Jose (Agency) has been dissolved, this website contains historical information about the Agency and will be used by the City of San Jose as the Successor Agency to the Redevelopment Agency of the City of San Jose to provide information related to the dissolution and winding down of the Agency. This website will be updated to provide additional information.

Due Diligence Report for the Low and Moderate Income Housing Fund

Pursuant to Health and Safety Code 34179.5, each Successor Agency shall employ a licensed accountant, approved by the County Auditor-Controller and with experience and expertise in local government accounting, to conduct two Due Diligence Reviews (DDRs) of the former Redevelopment Agency to determine whether there is any unobligated balance available for disbursement to the applicable taxing entities. The first report, of the Low and Moderate Income Housing Fund is now complete. The second report, for all other funds of the Successor Agency (excluding the Low and Moderate Income Housing Fund), is anticipated in January 2013.

Recognized Obligation Payment Schedule

The Recognized Obligation Payment Schedule (ROPS) details the obligations of the Successor Agency, in order to comply with the provisions of Section 34169 of the Health and Safety Code. A ROPS is prepared for both the first and last six months of each calendar year.

Second Amended Enforceable Obligation Payment Schedule

On January 31, 2012, the City Council adopted Resolution No. 76138 and the Agency Board adopted Resolution No. 6034, approving the Second Amended Enforceable Obligation Payment Schedule, which details the obligations of the Redevelopment Agency and the City of San Jose, as it relates to the Low and Moderate Income Housing Fund, in order to comply with the provisions of Section 34169 of the Health and Safety Code.


Amended Enforceable Obligation Payment Schedule

On September 27, 2011, the City Council adopted Resolution No. 76010 and the Agency Board adopted Resolution No. 6030, amending the Enforceable Obligation Payment Schedule to update the obligations of the Redevelopment Agency and the City of San Jose as it relates to the Low and Moderate Income Housing Fund in order to comply with the provisions of Section 34169 of the Health and Safety Code.


Enforceable Obligation Payment Schedule

Pursuant to Health and Safety Code Section 34169, the City Council and Agency Board adopted an Enforceable Obligation Payment Schedule that lists all of the obligations that are enforceable under AB X1 26. On August 23, 2011, the City Council adopted Resolution No. 75969, and the Agency Board adopted Resolution No. 6029:

In the past few years, redevelopment agencies throughout the State of California have been forced to turn over a combined total of $2.05 billion in local property taxes to fund the State’s budget demands.  In the last 12 months alone, San Jose had to send $75 million of local property taxes to the State, leaving City and Redevelopment Agency critical projects and programs unfunded.  Now, in spite of the voters approving Proposition 22 just last November, which said that the state had to stop taking property taxes, the state is again trying to take even more local money from San Jose.
